Club & League Partnership Terms

1Who these terms are between

These terms are between SportPicz.com ("SportPicz", "we") and the club or league whose representative accepted them ("the club"). They start when the club accepts them on its sign-up page and continue until either side cancels.

The person accepting confirms they are authorised to accept these terms on behalf of the club.

2No cost to the club

The club pays SportPicz nothing. There is no upfront payment, no fee, no minimum number of sales, and no commitment to buy anything. We pay for photographers, travel, equipment, galleries, checkout and delivery. No invoice for these services will ever be sent to the club.

3Cancelling

Either side may cancel at any time by emailing hello@sportpicz.com. Cancellation takes effect immediately for any tournament we have not yet photographed. There is no notice period and no penalty. Photographs already taken remain available to the families who can access them, and any revenue share already earned is still paid.

4What we photograph

We photograph the club's own athletes and teams in live game action at the tournaments and league games the club tells us about and we confirm in advance. We attend at our own cost.

Under these terms we are there to photograph your club. We do not photograph other clubs' athletes, and this agreement does not make us the official photographer of any tournament. Where a tournament or venue has its own photography rules, we follow them.

5What the club does

• Tells us which tournaments its teams are entered in, and lets us know when that changes.
• Passes our note on to its families so they know photography is happening and how to opt out.
• Confirms that its families have agreed to photography of their children as part of club or tournament registration.
• Gives us a contact for payment and a team list so we know who we are photographing.

There is nothing else for the club to do. There is no photo day to organise, no volunteers to find, and nothing added to any team's schedule.

6What families pay

$19.99 buys a family every photograph of their athlete from one tournament, at full resolution and without a watermark. A second child at the same tournament is $9.99. Families see every photograph before paying, and if we found fewer than five photographs of an athlete, that family does not pay. Buying is always the family's choice. Prices are in Canadian dollars and may change; we will tell the club at least 30 days before any change.

7The club's revenue share

The club receives 25% of the money we collect from the club's families for photographs taken at tournaments covered under these terms, after refunds and taxes.

We pay within 30 days of the end of each tournament, together with a report showing what sold. Payment is by e-transfer or cheque to the contact the club nominates. The club does not have to invoice us or chase the payment.

8Photographs, privacy and children

• There is no public gallery. Photographs are found only through a private face match, available to an athlete's own parents and guardians.
• Every photographer working under our name is insured, is identifiable in a SportPicz jersey, and works only in the public areas of the venue, such as courtside and the stands.
• Any parent or guardian may opt their child out at any time by emailing hello@sportpicz.com. We act on it as soon as we can, usually the same day. An opt-out overrides any consent given through registration.
• Photographs are deleted 90 days after each tournament unless a family has purchased archiving.
• The club does not receive the photographs and does not gain the right to use them. Using a child's photograph for club promotion would need that family's permission, which is theirs to give, not the club's or ours.
• We retain copyright in the photographs. As set out in our Terms of sale & use, we may use a small number of images to promote SportPicz, never where a parent has opted out, and we remove any specific image on request.
• How we handle personal information is set out in our Privacy policy.

9What we do not promise

We photograph as much of a tournament as we can, but we cannot guarantee that every athlete or every match is photographed. That is why families see their photographs before paying. If something prevents us attending a tournament we have agreed to cover, we will tell the club as early as we can.

10Not exclusive

These terms do not stop the club working with other photographers, and they do not stop us working with other clubs.

11Liability

We provide our services as they are. Our total liability to the club for any claim relating to this partnership is limited to the revenue share payable to the club for the tournament the claim relates to. Nothing here limits any rights that cannot be limited under Canadian law.

12Changes to these terms

If we change these terms, we will email the club's contact at least 30 days beforehand. If the club does not agree with a change, it can cancel under section 3.

13Governing law

These terms are governed by the laws of the Province of Alberta and the laws of Canada applicable there.
